1. Acceptance of Terms
By downloading or using the Breathe app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. The App is operated by Beyond Form ("we," "us," or "our").
2. Use of the App
Breathe is intended for personal, non-commercial mindfulness and breathing practice. You must be at least 13 years of age to use the App. You agree not to reverse engineer, decompile, or attempt to extract source code from the App. Any use of the App in violation of these Terms may result in termination of access.
The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition. Please consult a healthcare professional for medical concerns.
3. Subscriptions & Purchases
Certain features of the App require a paid subscription or one-time in-app purchase ("Premium"). All purchases are processed by Apple through the App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. We do not have access to your payment information. Refund requests should be directed to Apple.
4. Intellectual Property
All content within the App (including Metal shaders, animations, sound design, UI, and written copy) is the exclusive property of Beyond Form and protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works without our express written consent.
5. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Beyond Form does not warrant that the App will be error-free, uninterrupted, or free of harmful components.
6. Limitation of Liability
To the fullest extent permitted by law, Beyond Form shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, even if we have been advised of the possibility of such damages.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via an in-app notice or by updating the effective date above. Your continued use of the App after changes constitutes acceptance of the revised Terms.
